A BILL FOR AN ORDINANCE ESTABLISHING A FIRE DEPARTMENT OF THE CITY OF MARSHALL AND DEFINING ITS DUTIES AND FIXING THE COMPENSATION OF THE MEMBERS THEREOF.

BE IT ORDAINED by the Aldermen of the City of Marshall.

Section 1. A Fire Department for the City of Marshall is hereby created and shall consist of eleven persons to be appointed by the Mayor with the consent and advice of the Board of Aldermen. And shall be appointed for the term of one year, and when so appointed and confirmed shall constitute the Fire Department of said City of Marshall.

Section 2. The Mayor of said City of Marshall shall from the persons so appointed by him nominate a Chief of Fire Department whose nomination shall be confirmed by the Board.

Section 3. It shall be the duty of the members of the Fire Department under the direction of the Chief of Fire Department to take charge of the fire apparatus of said City and to see that it is in suitable condition to do service at all fires that may occur in said City of Marshall. They shall do and perform all other services that may be necessary to a proper and effective use of said fire apparatus, and to that end shall have power to use the water hydrants of said City to make connection therewith for the purpose of testing and trying the hose belonging to said Fire Department, and for the purpose of practice and drill, as well as for the purpose of extinguishing fires.

Section 4.It shall be the duty of said fire department to drill so as to become proficient in the management of said fire apparatus at least as often as once in each month, which drill shall be under the direction of the Chief of said department.

Section 5. The members of said Fire Department shall receive as compensation for their services when in actual attendance upon a fire within said City of Marshall, assisting in the management of said fire apparatus and in extinguishing a fire under the directions of said Chief of Fire Department, the sum of Three Dollars for the Chief and Two Dollars and Fifty Cents each for the other members of said Fire Department for each and every day or part of a day so employed; provided the bill for such services shall first be endorsed as "Correct" by the Chief of said fire department who shall certify that the services were actually rendered by the members in whose favor said bill is presented. Said members of said fire department shall be allowed per drill, above provided for, the sum of One Dollar per month provided that any member who shall neglect to drill shall receive no compensation under this ordinance.

Section 6. It shall be the duty of the Chief of said fire department to see that the hose and fire apparatus belonging to said City is properly cleaned and placed in proper condition to be used again immediately after the same shall be used by the fire department in extinguishing a fire or after being used in drill exercise.

Section 7. The Chief of said fire department is hereby vested with police power to be exercised at a fire, and may arrest any person interfering in any manner with the use of said fire apparatus during a fire.

Section 8. Any person who shall be appointed here under as a member of the fire department may be removed by the suggestion of the Mayor with the consent of the Board of Aldermen.

Section 9. This ordinance shall be in force and effect from and after its passage.
